Nick Siegfried, shareholder at M2E Client Siegfried, Rivera, Hyman, Lerner, De La Torre, Mars & Sobel in Coral Gables, was recently featured in the DBR regarding Deutsche Bank Trust Co. Americas v. Harry Beauvais. The suit was filed in 2007 for a $1.44 million penthouse. The lending bank, according to Siegfried, waited 11 months too long when they took over the suit from the loan servicer American Home Mortgage Servicing, Inc. The statute is 5 years. The condo association, Aqua Masters Association, Inc. obtained ownership of the property after the case was dismissed. While they won’t be able to sell the penthouse just yet, they may continue to rent it. Siegfried stated “the group is considering an appeal to challenge the lien.”
